Terms of Sale — The Cask Collective (Panama)

Scope. Direct-to-consumer sale in Panama of four fixed Collector’s cases (6×700 ml bottles).

1) Products and availability

  • We sell four cases (“Releases”). Contents, case counts, and prices are shown on product pages. No substitutions. No custom mixes.

  • Quantities are limited. Cases are assigned by order of payment. When a Release is sold out, it will show “Sold Out” and no further orders will be accepted.

2) Age restriction

  • Alcohol is sold only to persons 18+. We verify age at pickup or delivery. If age cannot be verified, we cancel and refund the order (less payment-processor fees, if any).

3) Prices, currency, taxes

  • Prices are shown in USD per case. Applicable taxes and delivery fees (if any) are disclosed at checkout. We may correct price/description errors before order acceptance.

4) Ordering and contract formation

  • Place an order through the microsite checkout. You will receive an order confirmation email. The contract is formed when we accept the order by email (usually the same confirmation).

  • We may decline or cancel an order and refund payment for reasons including stock errors, suspected fraud, non-payment, or legal/compliance issues.

5) Payment

  • 100% prepayment via [ACH], [Yappy], or card through Tilo Pay. We do not store full card data. Orders are fulfilled only after funds clear.

6) Referral/Promoter codes

  • Checkout may include an optional code for attribution. Codes do not change the price for buyers and do not imply endorsement. Misuse may lead to cancellation.

7) Limits per buyer

  • Initial limit: 1 case per Release per buyer. We may lift limits if stock remains.

8) Pickup and delivery

  • Pickup: Panama Viejo Business Center, Bodega G11B, Ciudad Panama, Panama. Bring a valid ID (18+). Authorized third-party pickup only if requested from the purchaser’s email.

  • Local delivery (when available): adult (18+) must be present. Delivery fees and areas are shown at checkout.

  • Timeline: typical preparation 3–7 business days after payment and/or bottling date (December 1st, 2025). We will email “Ready for pickup/shipping.”

9) Cancellations and refunds

  • You may cancel for a full refund until you receive “Ready for pickup/shipping.” We will deduct non-recoverable payment-processor fees where applicable.

  • After that notice, refunds are only available if we cannot fulfill your order or in case of severe damage verified by us.

10) Damage, shortages, and claims

  • Inspect on pickup/delivery. Report damage or missing bottles immediately, reject receiving the items and don't sign reception. We may replace affected bottles (if available, visible quality issues only) or refund the affected portion.

11) Quality control, substitutions, and mermas

  • Because Releases are fixed, we do not substitute bottles. If an inventory or quality-control issue prevents fulfillment, we will cancel and refund the affected order or item.

12) Title and risk

  • Title and risk transfer upon pickup by you or your authorized person, or upon delivery to the address you provided (adult signature).

13) Resale and conduct

  • Purchases are for personal use but the rum is yours and you can drink it, share it or sell it. Just do not promote minors or unsafe consumption.

14) Warranties and liability

  • Products are provided “as is” consistent with quality standards for premium spirits. To the extent permitted by law, we exclude indirect or incidental damages. Our maximum liability is the amount you paid for the affected order.

15) Force majeure

  • We are not liable for delays or failure caused by events beyond reasonable control (e.g., strikes, supply issues, regulations, natural events).

16) Privacy

  • Personal data is processed under our Privacy Policy (see footer). We use referral codes for attribution and fraud prevention.

17) Changes to these Terms

  • We may update these Terms. The version posted at checkout at the time of purchase governs your order.

18) Governing law and venue

  • These Terms are governed by the laws of the Republic of Panama. Courts of Panama City have jurisdiction unless the parties agree to arbitration.
