Legal framework. We process personal data under Panama Law 81 of 2019 and Executive Decree 285 of 2021.

1) Scope

This policy applies to the The Cask Collective microsite, checkout, and customer support for the direct sale of our Collector’s cases in Panama.

2) Data We Process

  • Identification & contact: name, email, phone; ID number at pickup for 18+ verification.

  • Order & payment: products, amounts, dates, order IDs, payment confirmations/tokens. We do not store full card numbers.

  • Delivery: recipient name, address, delivery notes.

  • Attribution: optional referral/promoter code entered at checkout; UTM campaign parameters.

  • Technical & analytics: IP, device/browser info, pages viewed, timestamps (from Wix/hosting and analytics tools such as GA4/Tag Manager).

  • Communications: messages sent to our support channels.

3) How We Obtain Data

  • Directly from you at checkout, forms, or support.

  • Automatically via site operation/analytics.

  • From service providers (e.g., payment gateway) as payment confirmations.

  • Cookies/Tracking notice (short): We use necessary cookies for site operation and may use analytics cookies (e.g., GA4). Marketing emails/SMS are sent only with prior consent or under allowed prior relationship rules. You can adjust browser settings to limit non-essential cookies.

4) Purposes and Legal Bases

  • Contract performance: to take orders, collect payment, prepare, and deliver/pick up your case; provide support.

  • Legal obligations: age verification, invoicing/records, compliance inquiries.

  • Legitimate interests: site security/fraud prevention, inventory and campaign attribution (without sensitive profiling), service improvement.

  • Consent: optional marketing communications and cookies where required.

5) Retention

  • Customer/accounting records: for the business relationship and then up to 5 years (statutory/defense periods).

  • Referral codes & UTM attribution logs: up to 24 months.

  • Aggregated/anonymous analytics: longer, for statistics only.
    We delete or anonymize when retention ends.

6) Sharing and Processors

We share data with processors who act on our instructions:

  • Payments: Tilo Pay (cards). Banco General: ACH/Yappy confirmations.

  • Logistics: local couriers for age-verified delivery.

  • Platform & hosting: Wix (site, storage), email/SMS providers (transactional notices), analytics (GA4/Tag Manager).

  • Authorities: when legally required.

7) International Transfers

Some providers may process data outside Panama. We use contractual and technical safeguards consistent with Law 81/2019 (e.g., processor agreements, security controls).

8) Your Rights

Subject to law, you may access, rectify, cancel, oppose (ARCO), request portability, and withdraw consent. To exercise rights, email info@panamacraftspirits.com (proof of identity may be required). You can opt out of marketing at any time.

9) Security

We apply reasonable technical and organizational measures to protect data. No system is 100% secure, but we work to prevent, detect, and respond to incidents.

10) Minors

Sales and the site are not directed to persons under 18. We verify age at pickup/delivery.

11) Updates

We may update this Policy. We will post the effective date below. Continued use after changes means you accept the updated Policy.
